Abstract. In 2012, I accepted to have a look upon a specific situation in the self-proclaimed Nagorno-Karabakh Republic. My task was to determine if the authorities of the Republic of Armenia were exercising or not any overall control upon the respective entity with military means. My resulting report was given to the European Court of Human Rights, to serve as an expert opinion on a case where multiple individuals were petitioning against Armenia, clamming that Republic of Armenia does not grant them access to their properties held in a location inside the territories of the self-proclaimed Nagorno-Karabakh Republic. After years of court proceedings, the Court ruled in favour of the plaintiffs. The Court found that Armenia is bearing responsibility over the affairs in Nagorno-Karabakh. But, the same Court accepted my report, in which my expert opinion was that the Republic of Armenia does not impose its military jurisdiction over the respective region and does not exercise an overall control, with its military power, over that region. In the present paper, I am presenting the main considerations of theoretical, methodological and factual nature which led me to the conclusions in my report.
