Globalizarea este unul din cele mai importante procese în viața socială în acești ani – este de fapt un marș continuu de când Guttenberg a descoperit tehnicile de tipărire.

Mulți ani globalizarea nu a fost evidentă pentru societate, era doar un capitol în câteva cărți care vorbeau despre teorie politică și conducere politică – numai în a doua parte a secolului al XX-lea acest fenomen social a intrat în atenția atât a politicienilor, cât și a oamenilor de știință. Într-o bună parte a analizelor a fost uitat un aspect important al globalizării – legislația și problemele juridice, deoarece cei mai mulți dintre analiști erau specialiști în filosofie, sociologie, științe politice, economie. Textul nostru încearcă să sublinieze câteva aspecte care sunt mai puțin văzute – dar cu importanță fundamentală în acest proiect. A încerca să creezi o lume nouă poate fi provocator pentru întreaga viață (pentru creator), dar în același timp poate fi o bătălie pentru toți juriștii – pentru că lume nouă înseamnă cu necesitate existența unei legislații noi (cu implementare la nivel universal).

În același timp legislația – văzută de o bună parte a populațiilor ca un obstacol făcut de stat împotriva competențelor lor, poate reprezenta cel mai important obstacol în calea globalizării – și dacă politicienii vor uita rolul ei fundamental în viața socială, rezultatele vor fi negative. Dar nu tot timpul politicienii înțeleg viața și istoria și legea de fier ale istoriei este că cine este incapabil să învețe din lecțiile sale va fi pedepsit.

Chestiunea fundamentală – ca în Hamlet – este dacă politicienii învață în fiecare zi sau din catastrofe?

Globalization is one of the most important processes in social life in those years – it is in fact a continuous march since Guttenberg discovered print techniques.
Many years globalization was not obvious for society, it was only a chapter in few books which spoken about political theory and political leadership – only in second part of XX-th century this social phenomenon had entered in both attention – of politicians and scientist. In a good part of analyzes it was forgot an important aspect of globalization – legislation and juridical problems, because most of the analysts was specialist in philosophy, sociology, political sciences, economist. Our text try to underline few aspects which are less seen – but with fundamental importance in this project. Trying to create a new world is might be a provocation for whole life (for the creator), but in the same time it can be a battle for all jurists – because new world means with necessity existence of a new legislation (with implementation at universal level).
In the same time legislation – seen by a good part of populations like an obstacle made by state against their skills can represent a subject of a lot of meetings, demonstration, etc. Legislation is only a part of new “global village”; with the same importance will be understood litigation in court and its procedures.
We believe that legislation will represent the most important obstacle in front of globalization – and if politicians will forget its fundamental role in social life, result will be negative. But not all the time politicians understand life and history, and iron law of history is that who’s incapable to learn form its lessons it will punish.
The fundamental question – like in Hamlet – is if politicians learn every day or only from catastrophes?
